SKOOKUM JIM MASON'S LAST WILL AND TESTAMENT

In the Matter of the Estate of James Mason, deceased.

BE IT KNOWN that on the 22 day of September, A.D. 1916, the Last Will and Testament of James Mason (known as Skookum Jim), late of Carcross, in the Yukon Territory, Indian, who died on or about the 11th day of July, 1916, at Whitehorse, in said Territory, and who at the time of his death had a fixed place of abode at Carcross, in said Territory, was proved and registered in the Territorial Court of the Yukon Territory, a true copy of which said Last Will and Testament is hereunto annexed, and that the administration of all and singular the property of the said deceased and any way concerning his Will was granted by the aforesaid Court to Issac O. Stringer, of Dawson, in the Yukon Territory, executor named in the Will, he having first duly sworn well and faithfully to administer the same by paying the just debts of the deceased so far as he may be bound by law and by distributing the residue, if any, of the property according to law, and to exhibit under oath a true and perf!
ect inventory of all and singular the said property and to render a just and true account of his executorship within eighteen months or sooner if thereunto required.

THIS IS THE LAST WILL AND TESTAMENT of me James Mason, otherwise known as Skookum Jim, of the Town of Carcross, in the Yukon Territory, an Indian, made this Fourth day of April, 1916.

I hereby revoke all former wills and testamentary dispositions made by me and declare this to be my last will and testament.

I direct that all my just debts funeral and testamentary expenses be paid and satisfied.

I devise and bequeath all trust funds or property over which I have power of appointment unto my trustees hereinafter named, upon trust, that as soon as said trust funds shall come into their hands under said appointment, they shall pay the following legacies:

To my sister Kate Carmack the sum of One thousand dollars ($1,000) payable in five yearly payments of $200 each:

To Patsy Henderson an Indian of said Town of Carcross the sum of One thousand dollars ($1,000):

To my cousin Caribou John, sometimes known as Tagish John, the sum of One thousand dollars ($1,000) to be paid to him in five yearly payments of $200 each:

To my relative Tagish Jim of Carcross the sum of Five hundred dollars ($500) payable in four annual payments of $125 each,

In the event of th death of any of said legatees before the legacy or any payment thereof becomes due then such legacy or payment shall remain part of said trust estate.

The balance of said trust funds to be known as "The Skookum Jim Indian Fund" my trustees may invest in any investments which they shall deem reasonably secure not being limited to investments in securities authorized by law, and the income from said trust funds shall be devoted towards furnishing medical attendance supplying necessities and comforts to Indians in the Yukon Territory and towards assisting needy and deserving Indians in the said Territory in any way or manner said trustees may deem best.

I appoint the Bishop of the English Church in the Yukon and the Commissioner of the Yukon Territory and their respective successors or representatives to be the trustees of this my will and of said trust fund.

And I declare that each or any of my trustees may at any time resign said trusteeship. And I also declare that if and whenever any trustee for the time being shall resign the trusteeship or refuse or become incapable to act as a trustee then in every such case it shall be lawful for the continuing trustee to appoint a new trustee or trustees in the place of the trustee resigning or refusing or becoming incapable to act as aforesaid:

And I declare that all trusts and powers hereby reposed and vested in my trustees may be exercised by the persons or person who shall for the time being be the trustees or trustee of this my will. And I also declare that each and every trustee shall be answerable for his own acts and defaults only, and not for any co-trustee, nor for any loss unless the same shall be caused by his own wilful act or default, and the trustees may reimburse themselves out of the trust funds all costs and expenses incurred by them in or about the execution of the trusts of this my will.

All the rest and residue of my estate I devise and bequeath to my daughter Daisy Mason.

I nominate and appoint Right Rev. I.O. Stringer D.D. Bishop of Yukon, to be the executor of this my will.

In witness whereof I have hereunto set my hand this 4th day of April 1916, at Whitehorse, Yukon Territory.

Signed, published and declared by the above named James Mason testator as and for his last will and testament in the presence of us both present at the same time who at his request and in his presence have hereunto subscribed our names as witnesses. The same having been first read over and explained to the said testator in our presence when he appeared to fully understand the same and made his mark thereto.
